These terms govern your use of www.boan.co.za and every page and service on it. By using the site you agree to them. If you do not agree, please do not use the site.
This notice is published in accordance with section 43 of the Electronic Communications and Transactions Act 25 of 2002, which requires a supplier offering goods or services online to make certain information available. That information appears in the contact block at the end of this document.
1Who we are
1.1This site is operated by Bonang M Investments (Pty) Ltd, registration number 2026/036723/07, a private company incorporated in the Republic of South Africa, trading as BOAN, whose directors are AM Maile and BM Mathabela.
1.2References to we, us, our and BOAN are references to Bonang M Investments (Pty) Ltd. References to you are references to the person using the site.
2Acceptance and changes
2.1Using the site, in any way and for any purpose, constitutes your acceptance of these terms as they stand at the time of use.
2.2We may change these terms at any time by publishing the changed version on this page. The version in force is the one published at the time you use the site, and the effective date appears at the head of this document.
2.3We may change, suspend or discontinue any part of the site at any time without notice.
3How you may use the site
3.1You may view, download and print material from the site for your own information and for the purpose of evaluating our services.
3.2You may not, without our prior written consent: reproduce or republish material from the site commercially; use it to train a machine learning model; scrape, harvest or systematically extract data from it; frame it within another site; or present it in a way that suggests an association with or endorsement by us that does not exist.
3.3You may not use the site to transmit anything unlawful, defamatory, harassing or infringing, to introduce malicious code, to attempt to gain unauthorised access to any part of it, or to interfere with its operation or with any other person's use of it.
3.4You may link to the home page provided the link is not misleading and does not imply an association that does not exist. We may withdraw permission to link at any time.
4Intellectual property
4.1All content on the site, including the BOAN name and wordmark, text, photography, illustration, layout, code and design, is owned by us or licensed to us and is protected by copyright, trade mark and other law.
4.2Work shown in our portfolio is displayed with the permission of the client concerned. Rights in that work vest in the client. Nothing on the site grants you any licence to reproduce it.
4.3Nothing on the site transfers or licenses any intellectual property right to you except the limited permission in clause 3.1.
5Enquiries and submissions
5.1The site includes forms through which you may request a quotation or contact us. Submitting one does not create any contract between us and does not oblige us to quote or to accept any instruction.
5.2A quotation we issue is not an offer capable of acceptance until it is issued in writing to you and remains open for acceptance. Work is performed only on the terms of our master services agreement and a signed statement of work.
5.3Do not send us confidential material through the site unless we have asked for it. Where you send us an unsolicited idea, concept or proposal, we are not obliged to keep it confidential and are not liable to you if we independently develop something similar.
5.4Personal information you submit is handled in accordance with our Privacy Policy.
6Accuracy and availability
6.1The site is provided as it stands. We take reasonable care with the information on it but we do not warrant that it is complete, current or free of error, and it may be changed without notice.
6.2Prices, rates and service descriptions on the site are indicative and are not an offer. The price that applies is the one recorded in a quotation issued to you.
6.3We do not warrant that the site will be available uninterrupted or free of defect, or that it or the server that makes it available is free of harmful code. You are responsible for your own device and security arrangements.
7Links to other sites
7.1The site may link to sites operated by others. Those links are provided for convenience. We do not control those sites, do not endorse them, and are not responsible for their content, their products or their handling of your information.
7.2Following an external link is at your own risk, and the terms and privacy policy of that site will apply to your use of it.
8Our liability to you
8.1To the fullest extent permitted by law, we are not liable for any loss or damage arising from your use of, or inability to use, the site, or from reliance on anything published on it, including indirect or consequential loss and loss of profit, data or business.
8.2Nothing in these terms excludes or limits liability that cannot lawfully be excluded or limited, including liability for fraud, for death or personal injury caused by our negligence, and any liability arising under the Consumer Protection Act 68 of 2008.
8.3You indemnify us against any claim arising from your breach of these terms or your unlawful use of the site.
9General
9.1If any provision of these terms is found to be unenforceable, it is severed and the remainder continues in force.
9.2Our failure to enforce any provision is not a waiver of it.
9.3These terms are governed by the laws of the Republic of South Africa, and you consent to the jurisdiction of the South African courts.
9.4Any complaint about the site or about our conduct should be sent to the address in the contact block below. We aim to respond within ten (10) business days.
