Terms and Conditions of Sale

The contract between BOAN and a customer of the online store: how an order is made and accepted, price, delivery, risk and ownership, and your statutory rights.

These terms govern every sale made through shop.boan.co.za. Placing an order means you accept them. Please read them before you buy, and keep a copy.

This is an electronic transaction, so the Electronic Communications and Transactions Act 25 of 2002 applies to it. Where you buy as a consumer, the Consumer Protection Act 68 of 2008 also applies. Nothing in these terms limits any right you have under either Act. Where a term conflicts with those Acts, the Acts prevail.

Delivery is dealt with in our Delivery Policy, returns and refunds in our Returns, Refunds and Cancellations Policy, and payment in our Billing and Payment Terms. Those documents form part of these terms.

1Who you are contracting with

1.1The seller is Bonang M Investments (Pty) Ltd, registration number 2026/036723/07, a private company incorporated in the Republic of South Africa, trading as BOAN. Our full particulars appear in the contact block below and are published in accordance with section 43 of the Electronic Communications and Transactions Act.
1.2You must be at least 18 years old and have legal capacity to contract. If you are under 18 you may order only with the assistance of a parent or guardian, who is then the contracting party.

2The products

2.1We describe every product as accurately as we can. Photographs are illustrative: colour reproduction varies between screens and printed and dyed goods vary slightly between production runs.
2.2Where a product is handmade, printed or dyed, minor variation in colour, placement and finish is a characteristic of the product and is not a defect.
2.3Sizes are given as a guide. Where a garment carries a size chart, that chart governs.
2.4Products are offered subject to availability. Stock levels shown on the site are indicative and are not a guarantee that an item is available.

3How an order is made and accepted

3.1The display of a product on the store is an invitation to do business, not an offer. Your order is the offer.
3.2A contract comes into existence only when we send you an order confirmation email. An automated acknowledgement that we have received your order or your payment is not acceptance.
3.3We may decline an order, in whole or in part, before acceptance, including where the item is out of stock, where a price or description was displayed in error, where we cannot deliver to your address, or where we reasonably suspect fraud. Where we decline after payment, we refund in full within seven (7) days.
3.4You will have an opportunity to review and correct your order before you submit it. If you spot an error after submitting, contact us immediately and we will correct it if the order has not yet been dispatched.
3.5We keep a record of each transaction and you may request a copy at any time.

4Price

4.1Prices are in South African Rand and, where we are a registered vendor, include VAT. Delivery is charged separately and is shown before you pay.
4.2The price that applies is the one displayed when we accept your order.
4.3Where a price is obviously wrong, for example through a typing or system error, and the error would have been apparent to a reasonable person, we are not bound by it. We will contact you, and you may confirm the order at the correct price or cancel it for a full refund.
4.4We may change prices at any time. A change does not affect an order we have already accepted.

5Payment

5.1Payment is due in full before dispatch. We accept the methods shown at checkout.
5.2Card details are entered directly with our payment provider on its own secure page. We never receive or store your card details.
5.3Ownership of the goods remains with us until we have received payment in full, notwithstanding delivery.

6Delivery and risk

6.1We deliver within the Republic of South Africa. Delivery timeframes, charges and areas are set out in our Delivery Policy.
6.2Where we do not agree a date, we deliver within thirty (30) days of accepting your order, as section 19 of the Consumer Protection Act requires. If we cannot, you may accept a later date or cancel and receive a full refund.
6.3Risk in the goods passes to you on delivery, being the moment the goods are handed to you or to a person at the delivery address who accepts them.
6.4You must examine the goods on delivery and tell us within seven (7) days if anything is missing, damaged in transit or not what you ordered.

7Cancellation, returns and refunds

7.1Because you buy online, section 44 of the Electronic Communications and Transactions Act gives you the right to cancel without reason and without penalty within seven (7) days of delivery, and to a refund within thirty (30) days of cancellation. You bear the cost of returning the goods.
7.2Section 56 of the Consumer Protection Act gives you the right, for six (6) months after delivery, to return goods that are defective, unsafe or not fit for their ordinary purpose, and to choose a repair, a replacement or a refund. We bear the cost of that return.

8Quality

8.1Every product carries the implied warranty of quality in section 56 of the Consumer Protection Act, which we do not exclude.
8.2That warranty does not cover fair wear and tear, damage caused by misuse, accident or failure to follow care instructions, or deterioration that is normal for the material.
8.3Care instructions accompany products that need them. Following them is a condition of a claim based on premature wear.

9Our liability

9.1To the fullest extent permitted by law, our liability arising from a sale is limited to the price paid for the goods concerned, and we are not liable for indirect or consequential loss.
9.2Nothing in these terms excludes or limits liability for fraud, for death or personal injury caused by our negligence, or any liability under section 61 of the Consumer Protection Act for harm caused by unsafe or defective goods.

10General

10.1We may change these terms at any time. The version that applies to your order is the one published when we accept it.
10.2We are not liable for a failure or delay caused by an event beyond our reasonable control, including a failure of national infrastructure, civil unrest or an act of government. Where such an event prevents delivery for more than thirty (30) days, either of us may cancel and we will refund you in full.
10.3Complaints should be sent to the address in the contact block below. We aim to resolve a complaint within ten (10) business days. If you are not satisfied, you may refer the matter to the National Consumer Commission or to a recognised consumer goods ombud.
10.4These terms are governed by the laws of the Republic of South Africa, and the parties consent to the jurisdiction of the Magistrates' Court.
10.5If any provision is found to be unenforceable, it is severed and the remainder continues in force.
